Form I-9 Frequently Asked Questions

PLEASE BE AWARE: All Form I-9s MUST include an employment date (in Section 2).

Do I have to make copies of supporting documentation?
Yes. Copies of all supporting documentation must be sent to Human Resources by close of business the second day of employment, preferably earlier.

Can an employee start work prior to completion of a Form I-9?
Yes, but the form should be completed and submitted as indicated above.

Where do I send the completed I-9 and copies of supporting documentation?
Please deliver (preferred) to Human Resources or fax to 706-583-0240.

If an employee transfers from another UGA department, does a new I-9 have to be completed?
No; however, the existing I-9 and supporting documentation should be obtained from the previous department and forwarded to HR within 24 hours of the employee's start date in the new department.

May I use a U.S. Visa as a supporting document for foreign nationals?
No. A Visa is not a valid document from List A on the Form I-9. Instead, you should use the foreign national's passport along with other documents such as the I-94, I-20 and DS-2019.

For example, in Section 2 of the Form I-9, do I just need to indicate I have viewed the employee's drivers' license?
No, that's not enough. Section 2 of the Form I-9 requires that specific ID numbers and expiration dates stated on the supporting documents must be legibly written on the Form I-9.

What if the foreign national does not yet have a Social Security number?
According to the Immigration and Naturalization Service (INS), you should complete the Form I-9 and leave the SS# field BLANK. Attach a copy of the application for SS# and send all to HR in the time frame described above. If the foreign national has not applied for a SS#, he/she should immediately do so and provide receipt of application. The department should then notify HR as soon as the SS# is obtained.

May I use "white-out" if I make a mistake on the Form I-9?
Please don't. The Form I-9 should not have any modifications, re-writes, strike-through text, or other corrections.

For verification, may I view copies of an employee's documentation?
No. Photocopies and faxed documents in lieu of originals are not acceptable. You should examine original documents, then make copies of the originals and attach the copies to the Form I-9.
